You expressly consent that we may use the personal data you have provided to us in order to process a free trial or subscription for the purpose of delivery and use of your free trial, subscription, or limited access account. For full subscription orders your email address, school/organisation and contact details will be added to our subscriptions database for invoicing, account settings and usage. For free trials, full subscription orders, and limited access accounts your email address (and given alternative email addresses) will be added to our newsletter mailing list (opt out is available). No further action is taken with the data, however, it does reside in a database and removal is available if requested at the end of trial or subscription cancellation.
We will use your registration information to administer and manage your account (e.g. resetting passwords and correspondence when appropriate), and to provide the products and services you have requested from us, including product updates and information. Should you wish to cancel a subscription your school/organisation must contact us in writing (by email) within 30 days of the date of your renewal invoice. Cancellation notification must be sent to firstname.lastname@example.org (or via the contact form on our website), after which you will receive confirmation of cancellation in a reply from us as validation. If cancellation notification is received after this 30-day period your invoice and subscription fee will be required to be paid in full. We cannot accept any cancellation notification outside of this 30 day period.
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as "Device Information".
In this policy the term "Personal Information" refers to Device Information and Order Information.
We use the Order Information to process any free trials or orders placed through the Site (payment information, invoicing and order confirmations etc). Please note we currently use XERO, Stripe Payments Europe and Active Campaign. Our Site is hosted at lightning-e.com.
Additionally, we use Order Information to communicate with you, screen our orders for potential risk or fraud, and provide you with information, updates or advertising relating to our products or services only, in line with the preferences you have shared with us. We use the Device Information to help us screen for potential risk and fraud (in particular your IP address), and to improve and optimise our Site (for example, generating analytics about how our customers browse and interact with the Site, and assessing the success of our marketing and advertising campaigns). We use Google Analytics to help us understand how our customers use the Site. Additionally, when you register for a free trial, order a subscription, or attempt to make a purchase through the Site, we collect information from you, including your name, school/organisation name, billing and school address, payment information (credit card numbers and purchase order information where necessary etc), email address information, and phone number. We refer to this information as "Order Information". When working with third parties we may use your Personal Information as described above.
Please note that we do not alter our Site’s data collection, and do not use tracking practices when we see a Do Not Track signal from your browser. If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through using the information below. Additionally, if you are a European resident we process your information in order to fulfil contracts we might have with you (making an order through the Site), or otherwise to pursue our legitimate business interests listed above. Please note that your information may be transferred outside of Europe, including Canada and the United States.
If a school/organisation uses the 5-a-day Pentathlon online results system, 5-a-day Fitness Ltd will store the following information on secure servers maintained by Lightning E-Com Ltd: School name, child name, date of birth, SEN status, Pupil Premium status, results data for events. Identity sensitive data will not be shared with anyone outside of our organisation, or used for commercial purposes.
The information gathered and stored is necessary in order to aid schools in the tracking and monitoring of pupil progress, and can only be accessed and viewed by staff members of that school, as authorised by the school. Authorised staff members at 5-a-day Fitness Ltd can also access this data for site maintenance only. All data will be stored until a pupil reaches primary school leaving age (end of August after reaching 11 years of age), at this point pupil personal data will be removed and the results data will become anonymous.
If you register for a free trial, or place a subscription order through the Site, we will maintain your Order Information for our records until you ask us to delete this information.
5-a-day Fitness is suitable for all ages but we advise adult supervision for minors using our site and resources.
